How to File a Small Claims Case in Mecklenburg County, North Carolina

Most personal injury attorneys will not accept a “small dollar value” car accident case. Your case is considered small if the total amount of your property damage is less than $2,000.00, and if you do not have any physical injuries.

However, if an attorney does not accept your case, do not give up. Instead, consider filing a small claims complaint to recover your damages if the insurance company refuses to pay. In North Carolina, the small claims court is part of the District Court Division, and the court assigns the cases to a magistrate judge for resolution.

You initiate the small claims process by filing a “Magistrate Summons,” or Form No. AOC-CVM-100, and a “Complaint for Money Owed,” or Form No. AOC-CVM-200. In Charlotte, North Carolina, you can file these forms with the small claims clerk on the 3rd Floor of the Mecklenburg County Courthouse, located at 832 East Fourth Street.

Why will I probably not be reimbursed for my attorney’s fees and costs?

Often a potential client will call our office and ask who pays my attorney’s fees. Sometimes they object when told that the contingency fee will come out of their award and state: “shouldn’t the other side pay my attorney’s fees and cost if I win? After all, the other side caused my injuries.” Unfortunately, the answer to that question is usually, “no.”

North Carolina Industrial Commission Implements New Medical Fee Schedule

In February, the North Carolina Industrial Commission approved a revised medical fees schedule that will save North Carolina’s Workers’ Compensation system about $27 million annually. The new fee schedule is currently going into effect and will continue to be implemented throughout 2017.

The Medical Fees Section of the North Carolina Industrial Commission is responsible for processing medical bills for services provided under a workers’ compensation claim. Medical bills are reviewed and sometimes adjusted before being submitted to the insurance carrier for payment. Under the previous medical fee schedule, certain fees were higher than the national average while other fees were low.

The new fee schedule reflects a compromise between workers’ compensation insurance carriers and medical providers. The new schedule was put into place in order to bring all reimbursement rates closer to the national average, to ensure that injured workers receive a high standard of medical care, and to reimburse health care providers with reasonable fees for their services.

2 school buses crash into each other; 2 children and 1 adult are killed in accident and 23 children hospitalized

Three people were killed when two school buses collided into each other in Knoxville, Tennessee on Tuesday at 3:00pm. An adult teacher’s aide on one of the buses was killed. Twenty-three other children were taken to the hospital; twenty of them were released. The buses were from two different elementary schools, Sunnyview Primary School and Chilhowee Intermediate School. The children on the buses were in the kindergarten through the third grade.

The two buses were headed in opposite directions on Asheville Highway when one bus turned left for an unknown reason, crossed a concrete median, and struck the other bus on the side. The bus that was struck flipped over and slid down the highway.  The other bus only received front end damage.

Accident Investigators from the Knoxville Police Department are investigating the crash with members of the Tennessee Highway Patrol, but the exact cause of the crash is not known. According to The Weather Channel, there was rain in the Knoxville area at the time of the crash. The National Transportation Safety Board (NTSB) also sent a crash investigation team to Knoxville to assist in the investigation.
