Texting and Driving in North Carolina and South Carolina

According to the Harvard T.H. Chan Center for Public Health, in 2011, 3,331 people lost their lives and 387,000 suffered injuries in crashes involving a distracted driver. According to the Greensboro News & Record, in 2013 law enforcement officials cited approximately 3,600 statewide for breaking the law.  A WRAL Investigates report found that 1,458 people were cited for texting while driving in Wake County in 2013 but of the 1,367 cases disposed of in the county that year, fewer than half resulted in drivers paying the $290 in fines and court costs.

However, even with increased awareness and with new anti-texting laws in recent years, we’re not making a significant dent in preventing texting and driving. The obvious question is “Why not?” The answer is that the new texting laws are hard to enforce. It is easy for drivers to get around the law by claiming that they were not texting, and it is difficult for officers to prove otherwise. Thus, many states have gone so far as to make it illegal to even hold a hands-free communication device while driving, and North Carolina is contemplating doing the same.

How to File a Small Claims Case in Mecklenburg County, North Carolina

Most personal injury attorneys will not accept a “small dollar value” car accident case. Your case is considered small if the total amount of your property damage is less than $2,000.00, and if you do not have any physical injuries.

However, if an attorney does not accept your case, do not give up. Instead, consider filing a small claims complaint to recover your damages if the insurance company refuses to pay. In North Carolina, the small claims court is part of the District Court Division, and the court assigns the cases to a magistrate judge for resolution.

You initiate the small claims process by filing a “Magistrate Summons,” or Form No. AOC-CVM-100, and a “Complaint for Money Owed,” or Form No. AOC-CVM-200. In Charlotte, North Carolina, you can file these forms with the small claims clerk on the 3rd Floor of the Mecklenburg County Courthouse, located at 832 East Fourth Street.

2 school buses crash into each other; 2 children and 1 adult are killed in accident and 23 children hospitalized

Three people were killed when two school buses collided into each other in Knoxville, Tennessee on Tuesday at 3:00pm. An adult teacher’s aide on one of the buses was killed. Twenty-three other children were taken to the hospital; twenty of them were released. The buses were from two different elementary schools, Sunnyview Primary School and Chilhowee Intermediate School. The children on the buses were in the kindergarten through the third grade.

The two buses were headed in opposite directions on Asheville Highway when one bus turned left for an unknown reason, crossed a concrete median, and struck the other bus on the side. The bus that was struck flipped over and slid down the highway.  The other bus only received front end damage.

Accident Investigators from the Knoxville Police Department are investigating the crash with members of the Tennessee Highway Patrol, but the exact cause of the crash is not known. According to The Weather Channel, there was rain in the Knoxville area at the time of the crash. The National Transportation Safety Board (NTSB) also sent a crash investigation team to Knoxville to assist in the investigation.

How to obtain and read a North Carolina Crash Report form (DMV-349)

How to obtain the North Carolina Crash Report form (DMV-349)?

If you are involved in a car, truck or motorcycle accident in North Carolina, you probably will want to get a copy of your accident report.  Reports are not prepared for every accident. Sometimes the only form that you will have is the Driver Exchange Form which lists the names, addresses for the drivers involved in the accident and their insurance companies. However, if the accident results in a fatality, personal injury, property damage of more than $ 1,000.00 or if the police seized a vehicle, then the office must prepare a crash report.

There are several websites in which to search for the report. Some county and city police departments have a P2C (Police to Citizen) website where you can find the reports. For example, the Greensboro Police Department’s crash report website is http://p2c.greensboro-nc.gov/.  Other county and city police departments might have a www.PoliceReports.US/ website. For example, the Charlotte-Mecklenburg Police Department’s crash report website can be found at http://cmpd.policereports.us/.  Crash reports are typically available 24-72 hours after the accident. If the accident happened on an interstate and the North Carolina State Highway Patrol investigated the accident, then the report can be found on the Department of Public Safety’s website at http://www.ncdps.gov/. If the report cannot be found online, then you might have to pay a visit to the local police department or you might have to submit a Crash Report Request Form (TR-67A) to the North Carolina Department of Motor Vehicles at 3105 Mail Service Center, Raleigh, NC 27699-3105.

Finding the crash report is easy, but you will need some basic information to find the report, such as the date of the accident and names of the drivers. Some websites charge a nominal fee of $0.00 to $6.00 to download the report, but if you get it in person at the local police department it is often free. [Read more…]
