Social Security Disability Overview

North Carolina and South Carolina Social Security Disability Attorney

Social Security Disability Insurance (SSDI) is a program administered by the Social Security Administration (SSA) and provides disability insurance benefits to workers who have become disabled and cannot work for a year or more. The SSDI program is subject to many rules and regulations that determine who may apply and who is eligible for benefits. The process for obtaining SSDI benefits can be long and arduous, especially since many SSDI beneficiaries are denied their benefits at first.

Social Security Disability Insurance

The Social Security Administration is responsible for issuing SSDI benefits. Generally, SSDI benefits are available to individuals who have worked and paid taxes into the system for many years before becoming disabled. In order to be eligible to receive SSDI benefits, an individual must be disabled. According to the SSA, a disability in an adult means that the individual in unable to engage in any substantial gainful activity because of a physical or mental impairment that has lasted, or is expected to last, for more than one year.

Determining what qualifies as “substantial gainful activity” can be difficult. Generally, substantial gainful activity is work that brings in income over a certain amount per month. Even though the SSA uses a set amount to determine if an individual is capable of substantial gainful activity, it is not the final determination. Low earnings will not necessarily establish that a person is disabled and qualifies for SSDI benefits. On the other hand, high earnings may not adequately represent substantial gainful activity if the person seeking benefits is disabled and working under unique or special circumstances.

States generally have Disability Determination Services that are funded through the Social Security Administration to make the determination as to whether an individual qualifies for Social Security disability benefits. While each case is different, the rise in SSDI claims has made the process for obtaining Social Security disability benefits long and complex and it is not uncommon for first–time applicants to be denied benefits.
