Medical Malpractice: Intubation Mistakes Have Serious Consequences

Surgeries are major medical procedures in which a doctor attempts to correct an injury or disorder through invasive means. Due to the painful sensation of incisions, patients are put into a coma during major surgical procedures. This coma temporarily “shuts down” the patient’s body, rendering them unconscious. They are not able to feel, see, hear or remember the act of surgery.

It is the job of an anesthesiologist, a doctor that specializes in supervising anesthesia, to administer the coma-inducing drug. Anesthesia is a mixture of different gasses such as nitrous oxide, sevoflurane, ether, etc. These gasses are inhalable yet dangerous if not administered properly.

Despite Drop in Medical Malpractice Lawsuits, Medical Negligence Related Deaths on the Rise in North Carolina

It may seem hard to believe, but medical malpractice and negligence are blamed for more than 250,000 deaths annually in the United States, by some estimates. That is third behind only heart disease and cancer. However, in North Carolina, lawsuits relating to medical malpractice and negligence had plummeted since 2011, when North Carolina lawmakers passed Senate Bill 33. This new law proposes stricter guidelines on the discovery process in an attempt to eliminate “frivolous lawsuits.” Additionally, it creates caps on damages awarded to plaintiffs who are successful in a medical malpractice or medical negligence lawsuit.

What is Involved in a Medical Malpractice Lawsuit?

The common conception of medical malpractice is that of worst-case scenario. Not all medical malpractice lawsuits are a result of the death of a loved one, however. There are many different ways doctors or medical professionals may have a medical malpractice charge or complaint brought against them. NC Opens Office to Combat SSD Fraud

In August, the Social Security Administration opened up a Cooperative Disability Investigations office (CDI) in North Carolina. The office is a joint venture between the State Bureau of Investigation and the inspector general. The agency is tasked with examining disability claims deemed highly suspicious. The agency hopes to prevent disability fraud by properly and thoroughly vetting claimants. Their goal is to only distribute payments to qualified recipients.

The new office in North Carolina is just one of the 37 CDI offices operating all over the country. Disability fraud is very real and the problem is only growing now that more people have access to the internet and tools to create fraudulent documents. These claims waste taxpayer’s money during disbursement and continue to waste money when the offenders are prosecuted.

Who Qualifies for Workers’ Compensation?

Workers’ Compensation is an insurance program that provides financial support to employees injured on the job. The Federal government has regulations in place for the entire country such as mandatory coverage, but each state mandates its own workers’ comp program for employees.

Workers’ comp is meant to provide support to workers in a variety of different industries. Employees are compensated for lost time from work and for medical expenses. The only drawback to workers’ comp is that it prevents you from suing the employer for damages. If your employer does not have workers’ comp coverage, you may be able to file a personal injury lawsuit.
