North Carolina Man Blacks Out Behind the Wheel of His Car and Kills Father of Four Girls – Found Guilty of Criminal Charges, What About Civil Liability?

It took jurors three hours to return a guilty verdict in a case where a man, Lee Hutchins, crossed the center line on Highway 64 and killed the father of four young girls. Hutchins was tried on charges of involuntary manslaughter and two counts of assault with a deadly weapon inflicting serious injury.

This wreck that killed Michael Piercy also injured his wife and his two youngest daughters. Hutchins was sentenced to just over a year to three years for two of the charges and for the second assault charge; Hutchins received a suspended sentence with five years probation. The Judge ordered Hutchins not to drive during the five-year period.

The wreck, according to Hutchins attorney, was largely related to his medical condition. According to records, Hutchins blacked out behind the wheel of his car due to low blood sugar just prior to crossing the center line.  [Read more…]

New Research Confirms that 440,000 People Die Every Year Because of Preventable Medical Errors

An article released recently by Take Justice Back published some alarming facts about medical care with their headlining sentence reading “[r]esearch has confirmed that 440,000 people die every year because of preventable medical errors.” The article goes on to note that the figure 440,000 is similar to the population of Atlanta, Georgia.

Imagine – Atlanta, Georgia, a city that easily falls within the Top 40 Largest Cities in all of the United States – wiped out by the negligence of another person that could have been prevented. Keep in mind, this figure does not include those persons who are irreparably injured by a medical professional, but are still alive.

The civil justice system is one of the few ways a person, or their loved ones, are able to seek justice for these kinds of wrongs that have happened to themselves or their families. In the news the legislature likes to use the terms “affordable healthcare” and “ease of access” when referring to Tort Reformation; what this really means is a lack of options for you, the person that has been injured. North Carolina Budget Cuts Could Lead to Dangerous Roads and Serious Injuries

Most often when we think about car or truck accidents, we imagine the parties actually involved in the wreck, not the State Highway patrol or the North Carolina Department of Transportation Crews. WBTV, however, recently discussed how state budget cuts may impact the safety of officers, state employees, and drivers in general.

The issue begins with the roads and those workers that maintain the roads, making repairs where needed, insuring the safety of bridges and the stability of guardrails, and maintaining the areas around the road to increase visibility. A cut in the budget for the NCDOT crews would mean less staff to keep our roads safe; a problem that NC doesn’t need according to the highway patrol, who claim that they already respond to approximately 4,800 wrecks a year on interstates 485, 85 and 77.

Searching for a nursing home that meets our loved one’s needs is a subject that is often avoided. More often than not, it can become a tedious decision, weighing the options of affordability against wanting the best of the best for your spouses or parents.

In small rural areas, the options for nursing homes or assisted living facilities may be very limited; versus a larger area, where you may have so many options that you become quickly overwhelmed.
